Creating Implied Agency Without Signing A Buyer Representation Agreement:
Agency relationships can be created in other ways other than in writing. You can create client relationships with buyers, other than having them sign a Buyer Representation Agreement.
When buyers ask Realtors questions and Realtors answer their questions and give them their opinion or advice, they’ve treated them like a client and in fact, then have a client on their hands. What do we know that as? The legislation refers to that as implied agency. Implied agency is the creation of client relationships by the things Realtors say and the things Realtors do, not just in writing.
When a cold lead says, “John your listing isn’t of interest to me. It’s outside of my budget.”, but you know there are other properties available for sale that are in fact within their budget. You created a client by implied agency or implied representation, and you have yet to get a BRA signed.
Let’s take it a step further than just that conversation. You’re also going to go ahead and email that buyer.
Here is what the email is going to look like.
“As per your request, here are the feature sheets of those properties. That we discussed on the telephone. Would you be available to take a look at them tomorrow afternoon?
As per your request, as a service to you, here is a summary of properties that have sold in the neighbourhood within the last 90 days. This service is designed to help you truly understand how the market is behaving, what market value truly is.
